This notice applies to KABITAT (the “Website”) and its contact, matching, document-download, map and related functions. The Website provides information and contact arrangements for first-hand residential properties in Hong Kong. By using the Website, submitting a form or interacting with us, you acknowledge that you have read and understood this notice.

In this notice, “personal data” means information that can identify you directly or indirectly; “processing” includes collection, recording, storage, use, transfer, disclosure and deletion; “we”, “us” and “our” mean the operator team of the Website; and “service provider” means a third party that processes data on our behalf.

This notice does not limit your rights under applicable law and does not exclude any liability that cannot be excluded by law.

2. Operator and contact

The Website is operated by its operator team. If you have questions about this notice, your personal data or the content of the Website, please use the contact form on the Website home page. To protect contact details from search engines and automated collection, we do not publish phone numbers, email addresses or instant-messaging IDs on this page.

If you are already in contact with an advisor, you may also raise your query with that advisor. For formal requests concerning personal-data rights, we recommend using the contact form so that we can record and follow up properly.

3. Information we collect

When you use the contact form, matching function or browse the Website, we may collect:

• The name, phone number and optional requirements you provide.
• Your selected priorities, property plan and contact preference.
• The page URL, language, browser type and technical information at the time you submit a form.
• The referring URL, landing page, UTM parameters, advertising click identifiers, session identifier, screen and viewport size, time zone, device type and page-view count.
• A server-generated request identifier, timestamp and basic security records.
• If you choose to share your location: latitude, longitude and accuracy generated by your device. We do not require you to enable location, and refusing does not prevent you from submitting the form.
• The result of human verification. We do not receive your full verification credential.

We do not ask for identity card numbers, bank or credit-card details, your full address, medical records or other information unrelated to your enquiry. Please do not enter unnecessary sensitive information in free-text fields.

4. Sources of information

We obtain information mainly from forms you choose to submit, your device’s browser, the hosting and human-verification services we use, and records of your interactions with advisors. We may also obtain project information from public developer websites, government announcements and media reports, but that information is not used to identify you.

5. Collection and legal bases

We collect information through forms you choose to submit, your device’s browser, and network-security and human-verification services provided by our hosting and verification providers. Our legal bases include your consent (for example, location, contact and marketing), pre-contractual steps needed to respond to your enquiry, our legitimate interests in preventing abuse and keeping the service secure, and compliance with legal requirements.

If you refuse to provide necessary contact information, we may be unable to arrange advisor follow-up or respond to your enquiry. You may choose not to provide location or optional requirements; this does not affect your use of other functions.

6. Purposes

• To arrange for an advisor to follow up on your enquiry, respond to your requirements and coordinate viewings.
• To route your enquiry to an appropriate contact based on the project, district, language and requirements you provide.
• To understand enquiry sources and advertising performance, and to improve the Website and the user experience.
• To maintain service quality, handle complaints and improve our processes.
• To prevent spam, abuse, fraud and unauthorised access.
• To comply with applicable laws, regulations or regulatory requirements.

We do not use your information for marketing unrelated to your enquiry, and we do not sell your personal data.

7. Automated matching and analysis

We may use the preferences, district, language and requirements you provide to assist in arranging an appropriate advisor or contact on a rule-based basis. The purpose is to improve matching efficiency. We do not make decisions with significant legal effects about you solely by automated means.

If you have questions about a matching result, or would like a human review, please use the contact form. We will arrange human follow-up within a reasonable time.

8. Direct marketing and opt-out

We do not use your information for marketing unrelated to your enquiry. If we later wish to send you project updates or market information, we will first obtain your consent, or rely on a basis permitted by applicable law, and will provide a clear opt-out method.

You may opt out at any time through the contact form or your advisor. Opting out does not affect consent given before the opt-out, nor does it affect limited records we must retain for legal or anti-abuse purposes.

9. Sharing and service providers

To provide the service, we may share necessary information with the following categories of service providers:

• Hosting and content-delivery provider: hosting, content delivery and network security.
• Human-verification provider: human verification.
• Instant-messaging notification provider: delivery of form notifications to the designated advisor or operator.
• A customer-relationship management, communications or analytics service if we adopt one in future. We will update this notice if we do.
• Legal, regulatory or law-enforcement authorities: only where required by law or necessary to protect rights.
• Professional advisers (such as lawyers, accountants or information-security consultants) under duties of confidentiality.

The Website does not currently maintain a separate customer database; form data is primarily transmitted through our website backend to an instant-messaging notification provider for advisor follow-up. We do not sell your personal data.

10. Cross-border transfer

Our hosting, content-delivery, human-verification and instant-messaging notification providers may process data outside Hong Kong. We take reasonable steps to ensure that data is appropriately protected during transmission and processing. By using the Website, you understand and agree to such necessary cross-border processing.

11. Retention

We retain information only for as long as needed for the purposes for which it was collected. The Website currently has no automatic deletion period; our operators review and clean records according to actual follow-up needs. If you request deletion, we will handle your request within a reasonable time, but may retain limited records required by law, to prevent abuse, or to handle disputes.

When information is no longer needed, we will delete or anonymise it securely. If technical constraints prevent immediate deletion (for example, backup systems), we will restrict its use and remove it within a reasonable period.

12. Cookies, sessionStorage and similar technologies

The Website uses the following cookies:

• cw_agent_*: remembers the matched advisor to avoid repeated matching within a short period; expires after 48 hours.
• cw_lead_*: prevents duplicate form submissions within a short period; expires after 48 hours.

We also use the browser’s sessionStorage to store the referring URL, UTM parameters, session identifier, page-view count and device information, which are sent with your enquiry when you submit a form. Our cookieless traffic-analysis service does not use cookies. We do not use advertising-tracking cookies.

You can clear cookies or close the tab at any time; some functions may then require you to repeat an action. Disabling cookies will not prevent you from browsing public content, but may affect matching or form functions.

13. Location data

Location data is collected only if you actively tick the consent box. It is used to help arrange a viewing route or respond to enquiries in your area. You may refuse to provide location without affecting form submission or other contact functions. Location data is passed to the advisor with your enquiry and is not used for continuous tracking or to build a movement profile.

The accuracy of location data depends on your device, network and environment; we do not guarantee that it is completely accurate. If you prefer not to provide a precise location, you may provide only a district or choose not to provide it.

14. Security and breach handling

We use HTTPS/TLS encryption, network-security features provided by our hosting provider and human verification, and we restrict access to personnel who need to handle enquiries. We also require service providers to take reasonable security measures.

However, no internet transmission or storage is completely secure. If we become aware of a data breach involving your personal data, we will take remedial steps in accordance with applicable law and the circumstances, and will notify you and relevant regulators where required. If you discover a security issue, please notify us through the contact form.

15. Data accuracy and your responsibilities

We take reasonable steps to ensure that the information we hold and use is accurate. Project information is subject to the latest announcements by the developer, vendor and relevant government authorities, and public information may change over time. You should verify important information yourself and should not rely solely on the Website for property, financial or legal decisions.

You should ensure that the contact information you provide is accurate and current. If your information changes, please notify us through the contact form so that we can update or correct it.

16. Your rights

Subject to applicable law, you have the right to:

• Access the personal data we hold about you.
• Request correction of inaccurate data.
• Request deletion of data that is no longer needed.
• Object to or restrict certain processing, or withdraw consent you previously gave.
• Request human review of an automated matching result.
• Raise a query or complaint about our data processing.

Please submit requests through the Website contact form. To protect your data, we may need enough information to verify your identity; we will respond within a reasonable time. Applicable law may permit us to refuse a request in certain circumstances, and we will explain our reasons.

17. Children and young people

The Website is not directed at persons under 18. We do not knowingly collect children’s personal data. If you believe we have collected a child’s data without consent, please notify us through the contact form and we will address it promptly.

18. Third-party links

The Website may link to developer websites, media reports, documents or other third-party sites. Those sites are operated by third parties and their content and privacy practices are outside our control. Please review their terms and privacy policies. We are not responsible for the content, accuracy or availability of third-party sites.

19. Acceptable use

You agree not to use the Website for any unlawful, fraudulent, abusive or disruptive purpose, including unauthorised automated scraping, mass collection of contact details, bypassing human verification, sending spam, attempting to intrude or damage systems, or infringing the intellectual-property or privacy rights of others.

We may take reasonable steps in response to a breach of this section, including restricting access, refusing service or reporting the matter to law enforcement.

20. Intellectual property and imagery

The design, text, code and original visual assets of the Website are owned by us or the relevant rights holders. Project names, trade marks, developer logos and project images belong to their respective owners and are used for identification and information only. They may not be copied, adapted, distributed or used commercially without written permission.

Computer-generated images, illustrations and artists’ impressions used on the Website may be edited or retouched and are for reference only. They do not represent actual units, views or surroundings. Copyright and usage terms for images are subject to the relevant rights holders’ terms.

21. Disclaimer

The Website is an independent information platform. Project names, addresses, developers, unit counts, areas, views, completion dates, school nets, sales arrangements and other information are for reference only. The latest announcements by the developer, vendor and relevant government authorities prevail. The Website does not constitute an offer, commitment, warranty or investment advice.

Public information may lag; units may also be re-offered if a transaction is cancelled, so the Website does not state a fixed sales status. You should verify information yourself and seek professional advice where needed. We are not liable for loss arising from use of or reliance on the Website’s information, except where liability cannot be excluded by law.

22. Governing law

This notice is governed by the laws of the Hong Kong Special Administrative Region. Disputes arising from this notice or the Website shall be submitted to the courts of the Hong Kong Special Administrative Region, unless applicable law requires another jurisdiction.

23. Changes, severability and entire agreement

We may update this notice from time to time; the latest version is the one published on this page. Continued use of the Website after an update means you accept the revised notice. If any provision of this notice is held invalid or unenforceable, the remaining provisions remain in effect.

This notice constitutes the entire agreement between you and us regarding the processing of data on the Website and supersedes prior related oral or written statements. Our failure or delay in exercising any right does not waive that right.
